Definitions:
L1: Lessee (The Customer) | L2: Lessor (CCBOAT at Sundancer Invest LLC)
1. Condition of Craft & Equipment
The L1 acknowledges he/she has carefully examined the craft and finds it suitable for the purpose for which it is leased, and that other accessory equipment is in suitable and acceptable condition; that he/she will maintain both craft and equipment in a safe, dependable condition while in his/her custody.
Cash security deposit shall be retained by the L2 as partial compensation for failing to return said rental craft in as good condition, ordinary wear and tear excluded, as when received; for reimbursement of articles damaged, missing or broken equipment. The foregoing shall not limit L2's ability to seek further damages at law or equity.
2. Weather & Permissions
- Daily Check: L1 is obliged to read the weather report daily on www.ccboat.com before starting boating. If no internet access is available, L1 must call L2 daily for permissions.
- Contractual Part: This daily information & permission is part of the rent contract.
- Cancellations: L2 reserves the right to cancel the agreement due to inclement or impending bad weather. Late delivery due to bad weather or technical problems (locks/lifts) will not result in a refund.
3. Prohibited Use
L1 agrees not to use, nor permit the use of the rental craft:
- For any unlawful purpose or in a careless/negligent manner.
- While under the influence of liquor or narcotics.
- By any person not the signatory of the contract or not equally qualified.
- For towing other boats, water skis, or knee boards.
- Docking on Caloosahatchee river properties without special permission from CCBOAT.
Fuel Warning: Filling gas is ONLY permitted at boat gas stations! Regular car gas stations are strictly prohibited.
4. Operation Area (SEA TOW Coverage)
The operation area is limited to Lee County waters only:
- North: Marker 49, Captiva Pass.
- South: Big Hickory Pass, Ft Myers Beach, Sanibel, Captiva & North Captiva Island.
- River: Up to ALVA.
- Offshore: Max. 0.5 mile offshore (Gulf of Mexico).
5. Malfunction & Safety
In the event of malfunction or breakdown, L1 will immediately report to L2. Continued use shall be at L1's risk. In case of technical problems (engine/steering), L1 must contact L2 immediately and wait for Sea Tow. L1 must not leave the craft before Sea Tow has it under safety control.
6. Cancellation Policy

Should any term be held void, the remainder of this Agreement shall remain in full force and effect.
